I, Angela Thokozile Didiza, Minister for Agriculture and Land Affairs, acting in terms of section 55 of the Sectional Titles Act, 1986 (Act No. 95 of 1986), after consultation with the sectional titles regulation board, hereby amend the regulations promulgated by Government Notice No. R.664 of 8 April 1988, as set out in the Schedule hereto.

SCHEDULE
Definitions
- In this Schedule "the Regulations" means the
regulations promulgated by Government Notice No. R.664 of 0 April 1988 (as
corrected by Government Notice R. 991 of 27 May 1988), and amended by
Government Notice No. R. 1791 of 3 August 1990, Government Notice No. R. 2345
of 5 October 1990 (as corrected by Government Notice No. R. 2542 of 2 November
1990), Government Notice No. R. 2653 of 8 November 1991 (as corrected by
Government Notice No. R. 2868 of 6 December 1991), Government Notice No. R.
1562 of 12 June 1992, Government Notice No. R. 60 of 15 January 1993,
Government Notice No. R. 1659 of 30 September 1994, Government Notice No. R.
l422 of 31 October 1997 and Government Notice No. R. 1357 of 19 November
1999.
Amendment of regulation 5
- Regulation 5 of the Regulations is hereby amended-
- by the substitution for paragraph (a) of subregulation (1) of the following paragraph:
"(a) It shall be prepared in black print of good quality on a good, durable drawing material of any of the following sizes: 297 x 210 mm; 297 x 420 mm or 297 x 841 mm.";
- by the deletion of paragraph (c) of subregulation (1);
- by the substi1ution for paragraph (d) of subregulation (1) of the following paragraph:
"(d) Margins 40 mm wide along the 297 mm side of the sheets and 10 mm wide along the other sides, shall be provided and such margins shall, subject to the provisions of paragraph (h), be left free of any writing or drawing.";
- by the insertion in paragraph (f) of subregulation (1) of the words "the nearest" between the words "expressed to" and "10 seconds.";
- by the substitution in paragraph (g) of subregulation (1) tor the words preceding subparagraph (i), of the following words;
"Any drawing on such plan shall be plotted to a standard scale: Provided that-";
- by the substitution in paragraph (h) of subregulation (1) for the expression "preparer thereof" of the expression "responsible land surveyor or architect" and the insertion of a comma after the word "purpose";
- by the insertion in paragraph (i) of subregulation (1) of the expression "or she" after the expression "he" and by the deletion of the words following the expression "interlineations";
- by the deletion of paragraph (j) of subregulation (1);
- by the substitution for paragraph (k) of subregulation (1) of the following paragraph:
"(k) All buildings, seciions and exciusive use areas, shall be uniquely numbered.";
- by the substitution in paragraph (m) of subregulation (1) for the expression "1927 (Act 9 of 1927)" of the expression "1997 (Act No. 8 of 1997)";
- by the substitution for paragraph (n) of subregulation (1) af the following paragraph:
"(n) Each sheet shall contain the following:
(i) The title of the sheet;
(ii) the sheet number and an indicatian of the number of sheets of which the draft sectional plan consist;
(iii) the name and address of the architect or land surveyor concerned or, if he or she is practising with a firm of architects or land surveyors, his or her name and the name and address of the firm, the signature of the architect or land surveyor, and his or her professional designation;
(iv) the date on which the architect or land surveyor signed the sheet;
(v) a space which shall be provided for the approval certiticate of the Surveyor-General,
provided that any departure from these requirements shall require the prior approval of the Surveyor-General."; and
- by -
(a) the insertion in subparagraph (vi) of paragraph (a) of subregulation (2) of the expression "or her"' after the expressions "him" and "his" and the expression "or she" after the expression "he";
(b) the deletion of the expression "himself" in subparagraph (vii) of paragraph (a) of subregulation (2);
(c) the insertion in subparagraph (xi) of paragraph (a) of subregulation (2) of the expression "or her" after the expression "he", and
(d) the deletion of the comma in subparagraph (vi) of paragraph (b) of subregulation (2).
Substitution of regulation 6
- The following regulation is hereby substituted for regulation 6 of the Regulations:
"6. Submission of Draft Sectional Plan to Surveyor-General
The submission of a draft sectional plan to the Surveyor-General in terms of section 7 of the Act for approval, must be accompanied by-
(a) a certificate from the land surveyor concerned that the scheme is not in conflict with any building line restriction appearing in the relevant title deed;
(b) a certificate issued by an architect or a land surveyor stating that the boundaries of the sections and common property are physically defined as contemplated in the Act;
(c) the field book or field plan which must contain the original record of all measurements made in the field, the name of the person who made the measurements and the date an which the measurements were taken;
(d) a list of co-ordinates of at least two corners or identified permanent features of each buiiding: Provided that the distances between such corners or features shall be adequate to provide an accurate determination of the position of each building: Provided further that the co-ordinates may be listed on the copy of the plan mentioned in subregulation (e);
(e) a plan on which the corners or identified permanent features are indicated and described;
(f) the median dimension plan which must indicate the boundaries and the final dimensions of each section as derived from the field measurements and the consistency adjustments.".
Amendment of regulation 7
- Regulation 7 of ihe Regulations is hereby amended by the substitution in subregulation (3) for the expression "1927 (Act 9 of 1927)" of the expression "1997 (Act No. 8 of 1997)".
Substitutlon of regulation 29
- The following regulation is hereby substituted for regulation 29 of the Regulations:
"29. A registrar shall not issue a certificate of real right contemplated in section 25 (6A) or section 27(1A) of the Act, unless a conveyancer certifies-
(a) that no unit in the scheme has been sold, donated or exchanged; or
(b) if an unit was so alienated, the developer had disclosed in writing to the aquirer thereof that application is to be made for the issuing of a certificate of real right in terms of section 25(6A) or section 27 (1A) of the Act.".
Amendment of Annexure 1
- Annexure 1 to the Regulations is hereby amended-
- by the substitution for the heading of Form V of the following heading:
"NOTIFICATION UNDER SECTION 35(5) OF THE SECTIONAL TITLES ACT, "1986"; and
- by the substitution for form W of the following form:

Amendment of Annexure 8
- Annexure 8 to the Regulations is hereby amended by the substitution for paragraph (b) of rule 5 of the following paragraph:
"(b) the managing agent or any of his or her employees or employee of the body corporate may not be a trustee unless he or she is an owner.".
- These regulations shall come into effect on the date of publication thereof in the Gazette.

Wysiging van regulasie 5
- Regulasie 5 van die Regulasies word hierby gewysig -
- deur paragraaf (a) van subregulasie (1) deur die volgende paragraaf te vervang:
"(a) Dit moet opgestel word in swart druk van goeie kwaliteit op 'n goeie, duursame tekenmateriaal in enige van die volgende groottes: 297 x 210 mm; 297 x 420mm of 297 x 841 mm.";
- deur paragraaf (c) van subregulasie (1) te skrap;
- deur paragraaf (d) van subregulasie (1) deur die volgende paragraaf te vervang:
"(d) Kantruimtes 40 mm wyd langs die 297 mm kant van die velle en 10 mm wyd langs die ander kante moet voorsien word, en behoudens die bepalings van paragraaf (h), mag daar nie in sodanige kantruimtes geskryf of geteken word nie.";
- deur die invoeging in paragraaf (f) van subregulasie (1) van die woorde "die naaste" tussen die woorde "tot" en "10 sekondes.";
- deur in paragraaf (g) van subregulasie (1) die woorde wat subparagraaf (i) voorafgaan, deur die volgende woorde te vervang:

(v) 'n ruimte wat gelaat moet word vir die Landmeter-generaal se goedkeuringsertifikaat,
met dien verstande dat enige afwyking van hierdie vereistes die voorafgaande goedkeuring van die Landmeter-generaal vereis."; en
- deur -
(a) die invoeging in subparagraaf (vi) van paragraaf (a) van subregulasie (2) van die uitdrukking "of haar" na die uitdrukking "sy" en die uitdrukking "of sy" na die uitdrukking "hy";
(b) die uitdrukking "hom" in subparagraaf (vii) van paragraaf (a) van subregulasie (2) te skrap;

Vervanging van regulasie 6
- Regulasie 6 van die Regulasies word hierby deur die volgende regulasie vervang:
"6. Voorlegging van konsepdeelplan aan Landmeter-generaal
Die voorlegging van 'n konsepdeelplan aan die Landmeter-generaal ingevolge artikel 7 van die Wet vir goedkeuring, moet vergesel wees van -
(a) 'n sertifikaat van die betrokke landmeter dat die skema nie teenstrydig is met enige boulynbeperking wat verskyn in die betrokke titelakte nie;
(b) 'n sertifikaat uitgereik deur 'n argitek of 'n landmeter wat meld dat die grense van die dele en gemeenskaplike eiendom fisies bepaal is soos bedoel in die Wet;
(c) die veldboek of -plan wat die oorspronklike rekord moet bevat van alle metings in die veld gedoen, die naam van die persoon wat die metings gedoen het en die datum waarop die metings gedoen is;
(d) 'n lys van koördinate van ten minste twee hoeke of geïdentifiseerde permanente kenmerke van elke gebou: Met dien verstande dat die afstande tussen sodanige hoeke of kenmerke voldoende moet wees om 'n akkurate bepaling van die posisie van elke gebou te bied: Met dien verstande verder dat die koördinate op die afskrif van die plan genoem in subregulasie (e) gelys kan word;
(e) 'n plan waarop die hoeke of geïdentifiseerde permanente kenmerke getoon en beskryf word;
(f) die middellyn-afmetingsplan wat die grense en die finale afmetings van elke deel soos afgelei van die metings in die veld en die bestaan- baarheidsaansuiwerings, aandui.".
Wysiging van regulasie 7
- Regulasie 7 van die Regulasies word hierby gewysig deur in subregulasie (3) die uitdrukking "1927 (Wet 9 van 1927)" deur die uitdrukking "1997 (Wet No. 8 van 1997)" te vervang.
Vervanging van regulasie 29
- Regulasie 29 van die Regulasies word hierby deur die volgende regulasie vervang:
"29. 'n Registrateur reik nie 'n sertifikaat van saaklike reg in artikel 25(6A) of artikel 27(1A) van die Wet bedoel, uit nie, tensy 'n transportbesorger sertifiseer -
(a) dat geen eenheid in die skema verkoop, geskenk of geruil is nie; of
(b) indien 'n eenheid aldus vervreem is, die ontwikkelaar skriftelik aan die verkryger openbaar het dat aansoek gedoen gaan word vir die uitreiking van 'n setifikaat van saaklike reg ingevolge artikel 25(6A) of artikel 27(1A) van die Wet.".

- Aanhangsel 1 tot die Regulasies word hierby gewysig -
